Alabama Beach Cart Rentals – Rental Agreement & Liability Waiver
Acknowledgments & Payment Authorization
I, the undersigned, acknowledge and agree to the following:
- I accept and agree to all the terms of this rental agreement.
- I authorize Alabama Beach Cart Rentals, LLC to charge my credit/debit card for:
- Damages, lost, or stolen equipment
- Violations, tickets, and penalties incurred during the rental period
- Dolly Cart: 150 lbs max
- Economy Cart: 225 lbs max
- Large Cart: 300 lbs max
- Inspect your items immediately upon delivery. Report any issues right away—no refunds or extensions will be issued after equipment has been accepted.
- Return Time: All carts must be returned by 6:00 AM on the pickup date to the designated drop-off location.
- Cart Tags must remain attached to the cart.
- Clean the cart before return (remove all sand and debris).
- Return the cart in the same condition it was delivered.
You are responsible for all equipment during the rental period. Charges for damage or replacement are as follows:
- Dolly Cart: $200
- Economy Cart: $250
- Large Cart: $350
Failure to return rental property or to pay for damage may constitute abandonment or refusal to deliver under Alabama law and is punishable accordingly. By signing this form, you consent to all such charges being billed to the credit card provided.
I grant permission to Alabama Beach Cart Rentals to use my image or likeness for promotional purposes.
Participant Agreement, Release, and Assumption of Risk
I understand and acknowledge that:
- Participation in the use of rental carts involves inherent risks, including but not limited to: injury, collision, equipment failure, and exposure to natural elements.
- I voluntarily assume all risks involved in renting and using a Dolly, Economy, or Large Cart.
- I hereby release and agree to indemnify Alabama Beach Cart Rentals, its employees, officers, agents, and affiliates from all liability, including negligence.
- I agree to cover all legal fees if Alabama Beach Cart Rentals must enforce this agreement.
- I confirm I have adequate insurance or accept full financial responsibility for any injury or damages.
- Any legal action shall be brought in the state of Florida, under Florida law.
- If any part of this agreement is found unenforceable, the remaining sections will remain valid and binding.
I have read and understood this entire agreement. I agree to its terms and understand the legal rights I am waiving. I understand that refusal to sign the acknowledgment will result in denial of rental services.
